New Jersey Cocaine Sales Attorneys
Cocaine Sales
In the state of New Jersey, cocaine or crack cocaine related charges are either first degree, or second degree charges. Cocaine distribution charges are first degree crimes, and carry the harshest penalties. Possession of the drug or possession with the intent to distribute the drug, is a second degree crime, and can lead to steep fines, probation and/or imprisonment.
Prosecutors can bring drug sales charges against any person suspected of illegally distributing or dispensing a controlled substance such as cocaine, generally referred to as coke or crack cocaine (crack). The difference between possession of cocaine with the intent to distribute and straight distribution charges is often a matter of quantity.
If, at the time of arrest, the defendant had at least one half ounce of cocaine or crack cocaine but less than five ounces, he or she will likely face possession with the intent to distribute cocaine charges. This second degree crime is punishable with fines up to $150,000 and between five and ten years of prison.
If the defendant was found to possess five or more ounces of the substance, he or she is likely to face the first degree criminal charge of distribution. A conviction of cocaine distribution is punishable by fines up to $200,000 and up to 20 years of imprisonment.
